15.2-938. Preference for purchase of recycled paper and paper products.

A. Any locality may by ordinance require that in determining the award of anycontract for paper or paper products to be purchased for use by any division,department, or agency of such locality, the purchasing agent for suchlocality shall procure using competitive sealed bidding and shall award tothe lowest responsible bidder offering recycled paper or paper products of aquality suitable for the purpose intended, so long as the bid price is notmore than ten percent greater than the bid price of the low responsive andresponsible bidder offering a product that does not qualify under subsectionB of this section.

B. For purposes of this section, recycled paper and paper products means anypaper and paper products meeting the EPA Recommended Content Standards asdefined in 40 C.F.R. Part 250.
