15.2-5305. What constitutes need.

The council may adopt a resolution declaring that there is need for ahospital authority in the city if it finds (i) that there are inadequatehospital facilities and medical accommodations from the operations of privateenterprises in the city and the surrounding area, or (ii) that the publichealth and welfare, including the health and welfare of persons of low incomein the city and the surrounding area, require the construction, maintenanceor operation of public hospital facilities for such inhabitants.
