3.1-8. Appointment; term; powers and duties; vacancy.

There shall be a Commissioner of Agriculture and Consumer Services in thistitle hereinafter sometimes referred to as the Commissioner, who shall beappointed by the Governor, subject to confirmation by the General Assembly,for a term coincident with that of the Governor. The Department shall beunder the management and control of the Commissioner. The Commissioner shallprepare, approve and submit all requests for appropriations and beresponsible for all expenditures pursuant to appropriations. He shall bevested with such powers and duties as are herein set out, and such otherpowers and duties as may be prescribed by law. Any vacancy in the office ofthe Commissioner shall be filled by appointment by the Governor pursuant tothe provisions of Article V, Section 10 of the Constitution of Virginia.
