3.1-796.80. Consumer remedies for receipt of diseased animal uponcertification by veterinarian.

If, at any time within ten days following receipt of an animal described asbeing registered or capable of being registered with any animal pedigreeorganization and subject to this chapter, a licensed veterinarian certifiessuch animal to be unfit for purchase due to illness, a congenital defectdeleterious to the health of the animal or the presence of symptoms of acontagious or infectious disease, the pet dealer shall afford the consumerthe right to choose one of the following options:

1. The right to return the animal and receive a refund of the purchase priceincluding sales tax; or

2. The right to return the animal and to receive an exchange animal ofequivalent value from the dealer, subject to the choice of the consumer.

The refund or reimbursement required by this section shall be made by the petdealer not later than ten business days following receipt of a signedveterinary certification as hereinafter provided.
