2006 Code of Virginia § 3.1-713 - Records to be kept by commission merchant

3.1-713. Records to be kept by commission merchant.

It shall be the duty of every commission merchant, having received any farmproducts for sale on commission, promptly to make and keep a correct record,showing in detail the following with reference to the handling, sale, orstorage of such farm products:

(a) The name and address of the consignor;

(b) The date received;

(c) The condition, grade and quantity on arrival;

(d) The date of such sale for the account of the consignor;

(e) The price for which sold;

(f) An itemized statement of the charges to be paid by the consignor inconnection with the sale;

(g) Each consignment of farm products shall be given a lot number or otheridentifying mark, which number or mark shall appear on all sales tags ortickets or on any other essential records needed to show what the productsactually sold for; and

(h) Records relating to sales of "farm produce" or "farm products" atauction, including sales tags, tickets or bills, shall be sequentiallynumbered and each such sequentially numbered record shall be properlyaccounted for in the operations of the commission merchant. Any record whichis altered in any fashion must bear the full signature of the personauthorized to make, and who is responsible for, the alteration.
