3.1-616. Enforcement of article.

The Board is charged with the enforcement of this article and for thatpurpose the Board and its authorized agents shall have the power to:

1. Enter and inspect all places within the Commonwealth where apples areproduced, packed or stored for sale, shipped, delivered for shipment, offeredor exposed for sale, or sold, and to inspect such places and all apples,containers and equipment found in any such places.

2. Institute injunction proceedings for violations of any provision of thisarticle or regulation adopted hereunder in any court of competentjurisdiction in any county or city of the Commonwealth where apples may befound improperly marked in violation of any provision of this article, eitherthrough the attorney for the Commonwealth or otherwise.

3. Prohibit in writing the movement in intrastate, interstate or foreigncommerce of any apples found improperly marked in violation of any provisionof this article or regulation adopted hereunder until such apples areproperly marked under this article or regulation adopted hereunder andreleased in writing by the Board or its authorized agent.
