3.1-249.71. Proceedings in case of violations.

If it appears from the examination of laboratory results or other evidencecollected during an investigation that any of the provisions of this chapteror the regulations issued thereunder have been violated, the Commissioner maycause notice of such violation to be given to the registrant, distributor,possessor, licensee, applicator or other person from whom such evidence wastaken. Any party so notified shall be given an opportunity to be heard undersuch regulations as may be prescribed by the Board. If it appears after suchhearing that there has been a violation of this chapter or the regulationsissued thereunder, the Commissioner may certify the facts to the Board or theproper prosecuting attorney and furnish the Board or that officer with a copyof the results of such examination or investigation.
