3.1-249.64. Use of pesticide or container inconsistent with labeldirections or regulations of Board; knowing use.

A. It shall be unlawful for any person to use or cause to be used anypesticide in a manner inconsistent with its labeling or regulations of theBoard, provided that such deviation may include provisions set forth inSection 2 (ee) of the Federal Insecticide, Fungicide and Rodenticide Act (7U.S.C. 136 et seq.); and it also shall be unlawful to dispose of containersor unused portions of pesticide inconsistent with label directions or theregulations of the Board in the absence of label directions, or if thoseregulations further restrict such disposal.

B. It shall be unlawful for any person to knowingly use any pesticide againstany organism that is otherwise protected under fish, game, or migratory birdlaws, without first obtaining authorization as necessary from the federal orstate agency responsible for the protection of the organism.
