3.1-249.45. When Board may refuse or cancel registration.

The Board may deny or cancel the registration of a pesticide if it finds,after a public hearing, that:

1. Considering the available information on the benefits of a product and anyassociated risks, use of the pesticide has demonstrated unreasonable adverseeffects on the environment; or

2. A false or misleading statement about the pesticide has been made orimplied by the registrant or the registrant's agent, in writing, verbally orthrough any form of advertising literature; or

3. The registrant has not complied or the pesticide does not comply with arequirement of this chapter or a regulation adopted under this chapter.
