3.1-249.31. Restriction or prohibition of certain pesticides, pesticidecontainers and residuals.
After considering the available information on the benefits of a product andany associated risks, the Board is authorized to prescribe regulations torestrict or prohibit the sale or use and disposal of any pesticide orpesticide container or residuals which:
1. Undesirably persists in the environment or increases due to biologicalamplification or unreasonable adverse effects on the environment;
2. Because of toxicity or inordinate hazard to man, animal, bird or plant maybe contrary to the public interest.
