2.2-2828. How certain officers removed from office.

The Secretary of the Commonwealth, the State Treasurer, the Comptroller, theSuperintendent of Public Instruction or the Commissioner of Agriculture andConsumer Services may be removed from office by joint vote of the two housesof the General Assembly, or, during the recess thereof, may be suspended bythe Governor. This power shall not be exercised by the Governor except formisbehavior, incapacity, neglect of official duty, or acts performed withoutdue authority of law. In any case in which this power is so exercised by theGovernor, he shall fill the office by a temporary appointment, and report tothe General Assembly, at the beginning of the next session thereof, the factof such suspension and the cause therefor, whereupon the General Assemblyshall determine whether such officer shall be restored or finally removed.
