Chapter 17 - Barbers, Beauticians and Manicurists
§ 451. Definitions

  • As used in this chapter, unless otherwise provided or the context requires a different construction, application, or meaning—
    • “Board” means the Virgin Islands Board for the Licensing of Barbers, Beauticians, and Manicurists created under section 451a of this chapter. “Commissioner” means the Commissioner of Licensing and Consumer Affairs. “Barber” means a person who engages in the practice of barbering. “Barbering” and “practice of barbering” mean and include the performance of the following practices upon the head of male human beings for any purpose whatsoever except for the treatment of disease or of physical or mental ailments:
      • (a) Shaving or trimming the beard or cutting the hair of males.

      • (b) Giving facial or scalp massages with oils, creams, lotions, or other preparations, either by hand or mechanical appliances to males.

      • (c) Singeing, shampooing, arranging, dressing, or dyeing the hair of males or applying hair tonic to males.

      • (d) Applying cosmetic preparations, antiseptics, powders, oils, clays or lotions to scalp, face, or neck of males.

      “Barbershop” means any store, establishment, place, or any part thereof, in which the practice of barbering is conducted. “Beautician” means a person who engages in the practice of beauty culture. “Beauty culture” and “practice of beauty culture” mean and include the performance of the following practices upon the head of a female human being for any purpose whatsoever for compensation, except for the treatment of disease or of physical or mental ailments:
      • (a) Cutting, styling, arranging, dressing, curling, waving, permanent waving, shampooing, cleansing, singeing, bleaching, dyeing, tinting, coloring, or similarly treating the hair of females.

      • (b) Giving facial or scalp massages with oils, creams, lotions, or other preparations, either by hand or mechanical appliances to females.

      • (c) Arching eyebrows of females.

      “Beautician shop” means any store, establishment, place, or premises, or any part thereof, in which the practice of beauty culture is conducted. “Manicurist” means a person who engages in the practice of manicuring. “Manicuring” and “practice of manicuring” mean the cleansing, dressing, or polishing of nails of a person. “Licensee” means a person entitled to engage in barbering, beauty culture, or manicuring under this chapter. “Apprentice” means a person pursuing in good faith a course of study in the practice of barbering, beauty culture, or manicuring, under the tutelage, supervision, and direction of a licensee and who assists such licensee in such practice.
