AN ACT

 

Amending Title 34 (Game) of the Pennsylvania Consolidated Statutes, in Pennsylvania Game Commission, further providing for organization of commission; and, in hunting and furtaking licenses, further providing for resident license and fee exemptions and for license costs and fees.

 

The General Assembly of the Commonwealth of Pennsylvania hereby enacts as follows:

 

Section 1.  Section 301(a) and (b)(7) and (8) of Title 34 of the Pennsylvania Consolidated Statutes are amended and subsection (b) is amended by adding a paragraph to read:

§ 301.  Organization of commission.

(a)  Composition.--The independent administrative commission known as the Pennsylvania Game Commission shall consist of [eight] nine competent citizens of this Commonwealth who shall be well informed on the subject of wildlife conservation and restoration and who shall be appointed by the Governor, by and with the advice and consent of a majority of the elected members of the Senate.

(b)  Qualifications.--The members of the commission shall be appointed from the various geographical sections of this Commonwealth so that one and only one shall be a resident of each of the following districts:

(7)  The counties of Susquehanna, Wyoming, Luzerne, Lackawanna, [Carbon, Wayne, Pike and Monroe] Wayne and Pike, constituting the seventh district.

(8)  The counties of [Schuylkill, Berks,] Chester, [Northampton, Lehigh,] Bucks, Montgomery, Philadelphia and Delaware, constituting the eighth district.

(9)  The counties of Carbon, Monroe, Schuylkill, Berks, Northampton and Lehigh, constituting the ninth district.

Section 2.  Section 2706 of Title 34 is amended by adding a subsection to read:

§ 2706.  Resident license and fee exemptions.

(h)  Volunteer instructor license.--

(1)  A volunteer instructor license shall be issued by the commission to an individual who meets all of the following:

(i)  Is a resident of this Commonwealth.

(ii)  Is certified by the commission as qualified to teach any of the hunter or trapper education curricula offered by the commission.

(2)  This subsection may not apply to a full-time employee of the commission.

Section 3.  Section 2709(a)(2) of Title 34 is amended by adding a subparagraph to read:

§ 2709.  License costs and fees.

(a)  License costs.--Any person who qualifies under the provisions of this chapter shall be issued the applicable license upon payment of the following costs and the issuing agent's fee:

(vi)  Volunteer instructor license - $1.

Section 4.  This act shall take effect as follows:

(1)  The addition of 34 Pa.C.S. §§ 2706(h) and 2709(a)(2)(vi) shall take effect in 60 days.

(2)  The remainder of this act shall take effect immediately.
