3-60-27. Eminent domain.

A municipality shall have the right to acquire by condemnation any interest in real property, including a fee simple title thereto, which it may deem necessary for or in connection with a community development project under the Community Development Law [ 3-60-1 to 3-60-37 NMSA 1978]. A municipality may exercise the power of eminent domain in the manner provided by the Eminent Domain Code [ 42A-1-1 to 42A-1-33 NMSA 1978], or when found appropriate by the board of commissioners or governing body, by the special alternative procedure for condemnation of property as provided by Sections 42-2-1 through 42-2-24 NMSA 1978. Property already devoted to a public use may be acquired in like manner. However, no real property belonging to the state or any political subdivision thereof may be acquired without its consent, unless in a manner authorized by law.
