3-60-24. Finding of necessity by local government.

No municipality shall exercise any of the powers conferred upon municipalities by the Community Development Law [ 3-60-1 to 3-60-37 NMSA 1978] until after its local governing body shall have adopted a resolution finding that:   

A.     one or more slum or blighted areas exist in the municipality; and   

B.     the rehabilitation, conservation, clearance, redevelopment, development or a combination thereof, of such area or areas is necessary in the interest of the public health, safety, morals or welfare of the residents of the municipality.
