NRS 606.010 Definitions. As used in this chapter, unless the context otherwiserequires, the words defined in NRS 606.020to 606.060, inclusive, have the meaningsascribed to them in those sections.

NRS 606.020 Businessday defined. Business day has the meaningascribed to it in 42 U.S.C. 653a(g)(3).

NRS 606.030 Departmentdefined. Department means the Department ofEmployment, Training and Rehabilitation.

NRS 606.040 Divisiondefined. Division means the Employment SecurityDivision of the Department.

NRS 606.050 Employeedefined. Employee has the meaning ascribedto it in 42 U.S.C. 653a(a)(2)(A).

NRS 606.060 Employerdefined. Employer has the meaning ascribedto it in 42 U.S.C. 653a(a)(2)(B).

NRS 606.100 Establishmentof directory: Division of Welfare and Supportive Services and Department ofHealth and Human Services to provide information to certain agencies.

1. The Division shall establish and maintain adirectory of the newly hired employees in this State that complies with therequirements set forth in 42 U.S.C. 653a.

2. Within 3 business days after the date informationregarding a newly hired employee is entered into the directory establishedpursuant to subsection 1, the Division of Welfare and Supportive Services ofthe Department of Health and Human Services shall provide the information tothe National Directory of New Hires established pursuant to 42 U.S.C. 653(i).

3. Each calendar quarter, the Department shall submitto the United States Secretary of Health and Human Services the informationrequired by the Secretary pursuant to 42 U.S.C. 653a(g)(2)(B).

4. Upon request, the Department shall provide theinformation included in the directory established pursuant to subsection 1 tothe agencies described in 42 U.S.C. 653a(h).

NRS 606.110 Departmentto provide information to Chief of Program for Enforcement of Child Support;Chief to compare information received from Department with information in statecase registry.

1. The Department shall, not less than onceeach business day, provide to the Chief of the Program for the Enforcement ofChild Support of the Division of Welfare and Supportive Services of the Departmentof Health and Human Services the information included in the directoryestablished pursuant to NRS 606.100. TheDepartment shall provide the information by electronic or magnetic transmission.

2. The Chief shall, pursuant to the provisions of 42U.S.C. 653a(f), compare the information received pursuant to subsection 1with the information contained in the state case registry established by theDivision of Welfare and Supportive Services of the Department of Health andHuman Services pursuant to 42 U.S.C. 654a.

NRS 606.120 Employerto provide Division with certain information concerning newly hired employees;Division to include in directory information received from employers; civilpenalty for noncompliance.

1. Each employer shall, within the timeprescribed in 42 U.S.C. 653a, provide to the Division a report that containsthe information required pursuant to 42 U.S.C. 653a concerning an employee.

2. The Division shall include in the directory ofnewly hired employees the information received pursuant to this section within5 business days after the receipt of the information.

3. In addition to any other penalty provided by law,the Division may adopt by regulation a civil penalty of less than $25 for anemployer who fails to comply with the provisions of 42 U.S.C. 653a. Any suchpenalty must be imposed by the Division after notice and an opportunity for ahearing.
