NRS 329.010 Shorttitle. This chapter may be cited as the CornerPerpetuation and Recording Law.

NRS 329.020 Declarationof policy. It is the purpose of this chapterto protect and perpetuate public land survey corners and information concerningthe location of such corners by requiring the systematic establishment ofmonuments and recording of information concerning the location of such corners,thereby providing for property security and a coherent system of propertylocation and identification, and eliminating the repeated necessity forreestablishment and relocations of such corners once they are established andlocated.

NRS 329.030 Definitions. As used in this chapter, unless the context otherwiserequires, the words and terms defined in NRS329.040 to 329.130, inclusive, havethe meanings ascribed to them in such sections.

NRS 329.040 Accessoryto a corner defined. Accessory to a cornermeans any exclusively identifiable physical object whose spatial relationshipto the corner is recorded. Accessories to a corner may be bearing trees,bearing objects, monuments, reference monuments, line trees, pits, mounds,charcoal-filled bottles, steel or wooden stakes or other physical objects.

NRS 329.050 Boarddefined. Board means the State Board ofProfessional Engineers and Land Surveyors.

NRS 329.060 Cornerdefined. Corner means a property corner, aproperty-controlling corner, a public land survey corner or any combination ofthese.

NRS 329.070 Cornerrecord defined. Corner record means awritten record of the establishment or restoration of a corner or accessory toa corner.

NRS 329.080 Monumentdefined. Monument means a physical structurethat occupies the exact position of a corner.

NRS 329.090 Property-controllingcorner defined. Property-controlling cornerfor a property means a public land survey corner or any property corner whichdoes not lie on a property line of the property in question, but which controlsthe location of one or more of the property corners of such property.

NRS 329.100 Propertycorner defined. Property corner means a geographicpoint on the surface of the earth which is on and a part of a property line andcontrols the location of such line.

NRS 329.110 Publicland survey corner defined. Public landsurvey corner means any corner actually established and monumented in anoriginal survey or resurvey used as a basis of legal description for issuing apatent for the land to a private person from the United States Government.

NRS 329.120 Referencemonument defined. Reference monument meansa special monument which does not occupy the same geographical position as thecorner itself, whose spatial relationship to the corner is recorded and whichserves to witness the corner.

NRS 329.130 Surveyordefined. Surveyor means any person who islicensed pursuant to chapter 625 of NRS topractice land surveying.

NRS 329.140 Recordingof corner record required; exception. Exceptas otherwise provided in NRS 329.145, asurveyor shall complete, sign and record or cause to be recorded with thecounty recorder of the county in which the corner is situated a written recordof the establishment or restoration of a public land survey corner. Except asotherwise provided in NRS 329.145, sucha recording must be made for every public land survey corner and accessory tothe corner which is established, reestablished, monumented, remonumented,restored, rehabilitated, perpetuated or used as control in any survey. Thesurvey information must be recorded within 90 days after the survey iscompleted.

NRS 329.145 Conditionsunder which surveyor not required to record corner record. A surveyor is not required to record a corner record if:

1. A corner record is recorded with the countyrecorder and the corner is found as described in the record; and

2. All information required in a corner recordpursuant to this chapter is included in:

(a) A record of survey recorded in accordance with theprovisions of NRS 625.340 to 625.380, inclusive; or

(b) A land subdivision map recorded in accordance withthe provisions of NRS 278.010 to 278.630, inclusive.

NRS 329.150 Authorityto record corner record. A surveyor may recordany corner record as to any property corner, property-controlling corner,reference monument or accessory to a corner.

NRS 329.160 Informationrequired for recording corner record prescribed by regulation. The Board shall, by regulation, prescribe the informationwhich is to be included in the corner record and the form in which such cornerrecord is to be presented and recorded.

NRS 329.170 Countyrecorder to keep records. The county recorderof the county containing the corner shall:

1. Receive the completed corner record and preserve itin a hardbound book. The books must be numbered in numerical order.

2. Make such records available for public inspectionduring all usual office hours.

NRS 329.180 Reconstructionor rehabilitation of monuments. Where a cornerrecord of a public land survey corner is required to be recorded pursuant tothe provisions of this chapter, the surveyor must reconstruct or rehabilitatethe monument of such corner and the accessories to such corner so that suchcorner and accessories may be readily located at any time in the future.

NRS 329.190 Cornerrecords: Signatures. No corner record may be recordedunless it is signed by a professional land surveyor or, in the case of anyagency of the United States Government, by the official making the survey, whoshall designate his official title and the agency for which he is employed.

NRS 329.200 Filingof preexisting corner records. Corner recordsconcerning corners established, reestablished or restored may be filed beforeJuly 1, 1969.

NRS 329.210 Penalties. Any surveyor who fails to comply with the provisions ofthis chapter is guilty of gross negligence, incompetency or misconduct in thepractice of land surveying as a professional land surveyor and is subject todisciplinary action pursuant to NRS 625.460.
