Interstate Compact Defining a Portion of the Arizona- NevadaBoundary on the Colorado River

NRS 234.130 Ratificationand approval of Compact. The Interstate CompactDefining a Portion of the Common Boundary Between the States of Nevada andArizona on the Colorado River between the point where the Nevada-Californiastate line intersects the 35th degree of latitude north and Davis Dam, whichwas executed on February 6, 1960, by the Colorado River Boundary Commissions ofNevada and Arizona, is hereby ratified and approved.

NRS 234.140 Termsand provisions of Compact. The terms andprovisions of the Compact referred to in NRS234.130 are as follows:

 

ARTICLE I. Purpose.

 

The boundary between the States of Arizona and Nevadaon the Colorado River between the point where the Nevada-California state lineintersects the 35th degree of latitude north and Davis Dam has becomeindefinite and uncertain because of meanderings in the main channel of theColorado River with the result that a state of confusion exists as to the trueand correct location of the boundary and the enforcement and administration ofthe laws of the two states have been rendered difficult.

The purpose of this Compact is to fix the location ofthe boundary line between the States of Arizona and Nevada on the ColoradoRiver between the point where the Nevada-California state line intersects the35th degree of latitude north and Davis Dam.

 

ARTICLE II.Description.

 

The boundary between the States of Arizona and Nevadaon the Colorado River between the point where the Nevada-California state lineintersects the 35th degree of latitude north and Davis Dam is herewith definedas a line passing through a series of fixed points located in the mid-channel ofthe Colorado River which are tied by bearing and distance to establishmonuments and described as follows:

 

Point No. 1, being the place ofbeginning where the Nevada-California boundary intersects the 35th degree oflatitude north; thence northerly 18,099.91 feet along a curve to the right(with a radius bearing North 633435East, a distance of 13,901.63 feet) to

 

Point No. 2, which point is North 512459 West 2,769.37 feet from theU.S.C.&G.S. Fort Mohave Triangulation Station; thence North 481031 East 1,383.38 feet to

 

Point No. 3, which point is North 230544 West 2,880.52 feet from theU.S.C.&G.S. Fort Mohave Triangulation Station; thence northeasterly2,625.09 feet along a curve to the right with a radius of 12,170.00 feet to

ARTICLE III.Ratification and Effective Date.

 

This compact shall become operative when it has beenratified and approved by the Legislatures of the States of Arizona and Nevadaand approved by the Congress of the United States.

NRS 234.150 Secretaryof State to transmit copy of law to Arizona; proclamation by Governor uponapproval by Arizona and Congress; publication. TheSecretary of State of the State of Nevada shall transmit a duly certified copyof NRS 234.130 to 234.180, inclusive, to the Governor of theState of Arizona. The Governor of this state, whenever officially advised thatthe State of Arizona has ratified and approved the Compact set forth in NRS 234.140 and whenever the Congress ofthe United States has approved the Compact, shall make proclamation of thatfact. A copy of such proclamation shall be published for three consecutiveweekly issues in a newspaper or newspapers of general circulation in ClarkCounty, Nevada.

NRS 234.160 Consentof Congress petitioned. The Congress of theUnited States, as soon as the State of Arizona has ratified and approved theCompact set forth in NRS 234.140, ispetitioned, pursuant to Article I, section 10, clause 3, of the United StatesConstitution, to give its consent to the settlement and location of theabove-described portion of the common boundary, as set forth in NRS 234.140, between the States of Nevadaand Arizona. The Secretary of State of the State of Nevada shall transmit dulycertified copies of NRS 234.130 to 234.180, inclusive, to the presidingofficers of the Senate and House of Representatives of the United States and tothe several Senators and Representatives from the States of Nevada and Arizonato the Congress of the United States, who are petitioned to take such action asthey deem proper to procure the consent of the Congress of the United States tothis Compact between the States of Nevada and Arizona.

NRS 234.170 Titles,rights and claims to lands not affected. Nothingcontained in the provisions of NRS 234.130to 234.180, inclusive, or any operationthereof shall prejudice the titles, rights or claims of any person, public orprivate, natural or artificial, to any of the lands herein involved, whethersuch titles, rights or claims arise or exist upon the basis that the landsaffected by the designation of boundary as set forth in the Compact and in NRS 234.130 to 234.180, inclusive, were previously a partof the State of Nevada and have now become a part of the State of Arizona orwere previously a part of the State of Arizona and have now become a part ofthe State of Nevada, or otherwise.

NRS 234.180 Recordingof evidence of ownership after approval by Congress; retroactive effect. From and after the date of approval by the Congress of theUnited States of the Compact set forth in NRS234.140, the county recorder of Clark County, Nevada, shall accept andrecord, without charge therefor, patents, deeds or other evidence of ownershipor interest in any lands recorded in Mohave County, Arizona, which werepreviously considered a part of the State of Arizona but are now includedwithin the boundary of the State of Nevada as described in NRS 234.140. Recordings made under theprovisions of this section shall have retroactive effect to the date of theiroriginal recording in the State of Arizona.

LOCAL GOVERNMENTAL BOUNDARIES

NRS 234.250 Recordingof plat of boundaries of local governments; changes in boundaries; restrictionson taxation for failure to comply.

1. In addition to any other requirement of law, eachlocal government, as defined in NRS 354.474,shall record the original official plat with:

(a) The county recorder, the county clerk or theregistrar of voters, and the county assessor of each county in which itsterritory or any part thereof is situated.

(b) The Department of Taxation.

2. All changes in boundaries made after the originalrecording of such plat must be recorded immediately with the offices with whichcopies of the original plat were recorded.

3. Until a local government complies with therequirements of subsections 1 and 2, it shall not levy or receive any advalorem or other tax or any other mandatory assessment.

4. This section applies to all local governmentsreceiving and expending funds on behalf of the public, regardless of theirdesignation.
