CHAPTER 161 - CONSERVATORS FOR MEMBERS OFTHE ARMED FORCES AND MERCHANT SEAMEN

NRS 161.010 Appointment. Whenever a person, referred to in this chapter as anabsentee, serving in or with the Armed Forces of the United States, or a personserving as a merchant seaman, has been reported or listed as missing, ormissing in action, or interned in a neutral country, or beleaguered, besiegedor captured by an enemy, has an interest in any form of property in this stateor is a legal resident of this state and has not provided an adequate power ofattorney authorizing another to act in his behalf in regard to such property orinterest, then the district court of the county of the absentees legaldomicile or of the county where such property is situated, upon petitionalleging the foregoing facts and showing the necessity for providing care of theproperty of such absentee made by any person who would have an interest in theproperty of the absentee were such absentee deceased, or on the courts ownmotion, after notice to, or on receipt of proper waivers from, the heirs andnext of kin of the absentee as provided by law for the administration of anestate, and upon good cause being shown, may, after finding the facts to be asaforesaid, appoint a conservator to take charge of the absentees estate, underthe supervision and subject to the further orders of the court.

NRS 161.020 Bond;reports; powers.

1. The court shall have full discretionary authorityto appoint any suitable person as conservator and may require a conservator topost an adequate surety bond and to make such reports as the court may deemnecessary.

2. The conservator shall have the same powers andauthority as the guardian of the property of an infant or incompetent and shallbe considered as an officer or arm of the court.

NRS 161.030 Terminationof conservatorship: Delivery of property.

1. At any time upon petition signed by the absentee,or on petition of an attorney-in-fact acting under an adequate power ofattorney granted by the absentee, the court shall direct the termination of theconservatorship and the delivery of all property held thereunder to theabsentee or to the designated attorney-in-fact.

2. If at any time subsequent to the appointment of aconservator it shall appear that the absentee has died and an executor oradministrator has been appointed for his estate, the court shall direct thetermination of the conservatorship and the delivery of all property of thedeceased absentee held thereunder to such executor or administrator.
