NRS 135.010 Shorttitle. This chapter may be cited as theUniform Simultaneous Death Act.

NRS 135.020 Insufficientevidence of survivorship. Where the title toproperty or the devolution thereof depends upon priority of death and there isinsufficient evidence that the persons died otherwise than simultaneously, theproperty of each person must be disposed of as if that person had survived,except as provided otherwise in this chapter.

NRS 135.030 Beneficiariesof another persons disposition of property. Wheretwo or more beneficiaries are designated to take successively by reason ofsurvivorship under another persons disposition of property and there isinsufficient evidence that these beneficiaries died otherwise thansimultaneously, the property thus disposed of must be divided into as manyequal portions as there are successive beneficiaries and these portions must bedistributed respectively to those who would have taken in the event that eachdesignated beneficiary had survived.

NRS 135.040 Jointtenants or spouses holding title to community property with right ofsurvivorship. Where there is insufficientevidence that two joint tenants or spouses holding title to community propertywith right of survivorship died otherwise than simultaneously, the property soheld must be distributed one-half as if one had survived and one-half as if theother had survived. If there are more than two joint tenants and all of themhave so died, the property thus distributed must be in the proportion that onebears to the whole number of joint tenants.

NRS 135.050 Insurancepolicies. Where the insured and thebeneficiary in a policy of life or accident insurance have died and there isinsufficient evidence that they died otherwise than simultaneously, theproceeds of the policy must be distributed as if the insured had survived thebeneficiary.

NRS 135.060 Communityproperty. Except as otherwise provided in NRS 135.050 or in a premarital agreementbetween spouses which is enforceable pursuant to chapter123A of NRS, where both spouses have died, leaving community property, andthere is insufficient evidence that they died otherwise than simultaneously,one-half of all the community property must be distributed as if one spouse hadsurvived and the other one-half thereof must be distributed as if the otherspouse had survived.

NRS 135.080 Chapterdoes not apply if decedent provides otherwise. Thischapter does not apply in the case of wills, living trusts, deeds, or contractsin which provision has been made for distribution of property different fromthe provisions of this chapter.

NRS 135.090 Uniformityof interpretation. This chapter shall be so construedand interpreted as to effectuate its general purpose to make uniform the law inthose states which enact it.
