Section 90. Whoever, in a book, pamphlet, circular, advertisement or advertising sign, or otherwise in writing, makes any false and fraudulent statement or assertion of endorsement, authority, approval or sanction of an incorporated college, university or professional school in this commonwealth or elsewhere, or of officers or instructors thereof, as a commendation or advertisement of a person or of his services, or of goods, wares, commodities, processes or treatment, shall be punished by a fine of not more than one thousand dollars or by imprisonment for not more than one year, or both.
