61.340 County or city clerk to deliver records to successor -- Penalty for failure. Upon the resignation, removal from office or expiration of the term of office of a county or city clerk, he shall immediately, upon application, deliver to his successor, or such other person as the city or county legislative body orders, all books, records and other papers belonging to his office, and for failure to do so he shall be fined one thousand dollars ($1,000) and imprisoned from one (1) to twelve (12) months.
