(1) (2) (3) Any person making a false statement in the application provided for in KRS 365.410 to 365.480 is guilty of perjury and shall be imprisoned for not more than five (5) years. Any person who advertises, represents or holds out to the public any sale of goods to be an insurance, bankruptcy, mortgage foreclosure, insolvent's, assignee's, executor's, administrator's, receiver's, trustee's, removal sale, going out of business sale, or fire sale without having first complied with the provisions of KRS 365.410 to 365.480, is guilty of a misdemeanor and shall be fined not more than $500 or shall be imprisoned in the county jail for not more than six (6) months, or both. Any person who holds, conducts, or carries on any sale of goods contrary to the provisions of KRS 365.410 to 365.480, or who violates any of the provisions of KRS 365.410 to 365.480 is guilty of a misdemeanor, and shall be fined not more than $500 or shall be imprisoned in the county jail for not more than six (6) months, or both.
