(1) (2) The legislative body of any wet or moist city with a population equal to or greater than three thousand (3,000) based upon the most recent federal decennial census or a consolidated local government shall by ordinance create the office of city alcoholic beverage control administrator, or shall assign the duties of this office to a presently established city office. Except as provided in KRS 241.170(1)(b), the legislative body of any wet or moist city with a population of less than three thousand (3,000) based on the most recent federal decennial census may, by ordinance, create the office of city alcoholic beverage control administrator or shall assign the duties of the office to a presently established office.
