(1) (2) (3) The cabinet may require that any applicant for a grant under Title II of The Federal Water Pollution Control Act (33 U.S.C. secs. 1251 et seq.) shall adopt and maintain a system of charges in keeping with Section 1284(b) and to establish a special account as set forth in Section 1284(b)(3) of the Act. If an applicant for a Title II grant lacks statutory authority to conform with subsection (1) of this section, this section provides such statutory authority. If the system of charges required, under Section 1284(b) of the Act, creates a significant incentive for industries discharging into publicly owned treatment works applying for a Title II grant to relocate in other areas of the Commonwealth, or if the system of charges required under Section 1284(b) discourages publicly owned treatment works from seeking Title II grants, then the cabinet may require that all publicly owned treatment works in the Commonwealth adopt and maintain a system of charges comparable to those required by Section 1284(b) of the Act.
