The secretary may grant individual variances beyond the limitations prescribed in KRS 224.30-100 to 224.30-190 or in any regulation promulgated pursuant to KRS 224.30-100 to 224.30-190, whenever it is found, upon presentation by the petitioner of adequate proof, that compliance with any provision of KRS 224.30-100 to 224.30-190, any regulation promulgated under it or an order of the secretary would impose an arbitrary or unreasonable hardship. In granting or denying a variance, the secretary shall file and publish a written opinion stating the facts and reasons leading to his decision. Effective: June 21, 1974 History: Created 1974 Ky.
