(1) (2) A person is guilty of criminal possession of a forged prescription when, with knowledge that it is forged and with intent to defraud, deceive, or injure another, he utters or possesses a forged prescription for a controlled substance. Criminal possession of a forged prescription is: (a) For a first offense, a Class D felony. (b) For a second or subsequent offense, a Class C felony. Effective:July 15, 1998 History: Created 1998 Ky.
