(1) (2) No warehouseman shall select different qualities of the same grade of grain for the purpose of storage or delivery, or attempt to deliver grain of one grade for another, or in any way tamper with grain while in his possession or custody with a view of securing any profit for himself or for any other person, but he may, on request of the owner of any grain stored in a private bin, dry, clean or otherwise improve the condition or value of that grain, and in such cases the warehouseman shall deliver the grain only as a separate lot, or as the grade it was originally when received by him, without reference to the grade it may be as improved by the process of drying or cleaning. This section does not prevent any warehouseman from moving grain for the purpose of preservation or safekeeping. Effective: October 1, 1942 History: Recodified 1942 Ky.
