281A.2102 Additional penalties for driving commercial motor vehicle under the influence of alcohol. In addition to the penalties established by this chapter for driving a commercial motor vehicle under the influence of alcohol: (1) Any person convicted of driving a commercial motor vehicle while the alcohol concentration of the person's blood or breath is four hundredths (0.04) to eight hundredths (0.08) shall be fined not less than twenty dollars () and not more than fifty dollars (). (2) Any person convicted of driving a commercial motor vehicle while the alcohol concentration of the person's blood or breath is greater than eight hundredths (0.08) shall be fined under the provisions of KRS 189A.010(5)(a) to (d).
