243.420 Recovery on bond. A suit to recover on any of the bonds mentioned in KRS 243.400 and 243.410 may be brought in the Franklin Circuit Court or in the circuit court of the county in which the licensed premises are located, in the name of the state, by the commissioner of the Department of Revenue or on relation of any party aggrieved. If the obligor named in the bond has violated any of the conditions of the bond, recovery of the penal sum of the bond may be had in favor of the state or of the party aggrieved; or judgment for tax, penalties and interest may be rendered in favor of the state.
