216.170 Use of surplus in operating fund. If a surplus is accumulated in the operating and maintenance fund equal to the cost of maintaining and operating the municipal hospital during the remainder of the calendar, operating or fiscal year, as may be provided by the ordinance required by KRS 216.160, the city legislative body may at any time transfer the excess to the depreciation account to be used for any improvements or additions to the hospital.
