67A.330 Preservation of employees' rights. From and after the effective date of the urban-county form of government there shall be, with respect to each employee, an inviolable contract between the urban-county government as employer and such employee; and the urban-county government and its employees shall continue to operate under KRS 67A.230 to 67A.330 and all substantial matters contained in the ordinance first adopted hereunder. A repeal or modification of substantial provisions of that ordinance by the urban-county government shall in no wise affect such contract, unless by the mutual consent of the urban-county government and the affected employee. Such contract and right shall not be affected, either directly or indirectly, by an action of the urban-county government, its legislative body, executive officers, citizens or voters, whether under the guise of altering its form of government, adopting a new form of government or classification, abolishing any governmental or municipal entity, and substituting same with another governmental or municipal entity, or any other means whatsoever. The first ordinance referred to in this paragraph shall include, if applicable, any ordinance of a city, county or other municipality existing prior to the adoption of the urban-county form of government which is adopted by the urbancounty government for any period of time by its comprehensive plan or ordinance. The said contract shall include, and such actions shall not affect any substantial matter, including procedures and structures, for both pension and merit systems.
