Whenever a statute mentions an alternative to incarceration, that alternative may include a <br>community-based, faith-based, charitable, church-sponsored, or nonprofit residential or <br>nonresidential counseling and treatment program and, upon petition by the defendant, the <br>court may sentence or permit the defendant to attend that program. This program may <br>also be used for pretrial diversion. Effective: July 15, 1998 <br>History: Created 1998 Ky. Acts ch. 606, sec. 166, effective July 15, 1998.
