(Repealed, effective January 1, 2011) (1) Except as provided in subsection (2) of this section and KRS 275.065(3), a document shall be effective at the time of filing on the date it is filed, as evidenced <br>by any means the Secretary of State may allow for the purpose of recording the date <br>and time of filing, or at the time specified in the document as its effective time on <br>the date it is filed. (2) A document may specify a delayed effective time and date. If the document does so specify and is filed pursuant to subsection (1) of this section, then the document <br>shall become effective at the time and date specified. If a delayed effective date but <br>no time is specified, then the document shall be effective at the close of business on <br>that date. A delayed effective date for a document shall not be later than the <br>ninetieth day after the date it is filed. (3) A document filed in accordance with this section shall be effective regardless of a failure to file the document with the county clerk pursuant to KRS 275.045(11). Acts ch. 137 shall be deemed <br>effective as of June 26, 2007, and those provisions are hereby made expressly <br>retroactive to that date, with the remainder of the text of those sections being <br>unaffected by the provisions of this section.&quot; Legislative Research Commission Note (1/1/2011). 2010 Ky. Acts ch. 151, sec. 151 has repealed this statute effective January 1, 2011.
