273.178 Reserved name. (Repealed, effective January 1, 2011)
(1) A person may reserve the exclusive use of a corporate name, including a fictitious
name for a foreign corporation whose corporate name is not available, by delivering <br>an application to the Secretary of State for filing. The application shall set forth the <br>name and address of the applicant and the name proposed to be reserved. If the <br>Secretary of State finds that the corporate name applied for is available, he shall <br>reserve the name for the applicant's exclusive use for a nonrenewable period of one <br>hundred twenty (120) days. Within thirty (30) days of the expiration of a <br>reservation, the holder thereof may apply to renew the reservation on such form as <br>shall be provided by the Secretary of State. The renewal shall be effective as of the <br>expiration of the current reservation and shall renew the reservation for an <br>additional one hundred twenty (120) days from the expiration.
(2) The owner of a reserved corporate name may transfer the reservation to another
person by delivering to the Secretary of State a signed notice of the transfer that <br>states the name and address of the transferee.
(3) The holder of a reserved corporate name may cancel the reservation by delivery to
the Secretary of State of a notice of cancellation, executed by the applicant for <br>whom the name was reserved, that states the reserved name and its date of <br>reservation.

Legislative Research Commission Note (7/15/2010). 2010 Ky. Acts ch. 51, sec. 183,
provides, "The specific textual provisions of Sections 1 to 178 of this Act which <br>reflect amendments made to those sections by 2007 Ky. Acts ch. 137 shall be deemed <br>effective as of June 26, 2007, and those provisions are hereby made expressly <br>retroactive to that date, with the remainder of the text of those sections being <br>unaffected by the provisions of this section."
Legislative Research Commission Note (1/1/2011). 2010 Ky. Acts ch. 151, sec. 151,
has repealed this statute effective January 1, 2011.
