313.340 Appeal from order revoking, suspending or refusing to renew license. Any licensee aggrieved by an order of the board may, within thirty (30) days from the date of entry of said order, appeal to the Circuit Court in and for the county in which was held the meeting of the board at which the action of the board complained of was taken. In case a person desires to take such an appeal he shall file with the clerk of the Circuit Court to which the appeal is taken a petition setting forth the grounds of appeal, and shall file with said clerk an appeal bond with good and sufficient security, to be approved by said clerk, to the State of Kentucky, conditioned for the speedy prosecution of such appeal, and the payment of such costs as may be charged against him upon such appeal. Summons on such an appeal shall be issued and may be served on the president or secretary of the board in any county in this state where either of them may be found. Within ten (10) days after the service of summons on such appeal, the secretary shall transmit to the clerk of the Circuit Court, to which said appeal is taken, a certified copy, under the seal of the board, of all evidence considered and orders entered by the board in connection with said proceeding. The clerk of such court shall thereupon docket such appeal. The court shall only hear and consider such documentary and other evidence as was heard and considered by the board, and that is contained in the transcript upon which the appeal is taken. Either party may appeal from the judgment of the Circuit Court to the Court of Appeals in the manner as civil actions may be appealed thereto. The order of the board appealed from shall be stayed from the date of the approval of said bond until final determination of the appeal. History: Created 1942 Ky. Acts ch. 60, sec. 9.
