107.390 Condemnation powers of board. The district shall have the same power to condemn property for its purposes as the Department of Highways of the Commonwealth of Kentucky, and shall institute any action for condemnation under the provisions of the statutes applicable to said department. The official order of the board shall be conclusive of the public use of the condemned property and the board's decision as to the necessity for taking the property will not be disturbed in the absence of fraud, bad faith, or abuse of discretion.
