MEMORANDUM OPINION Before Justices Longoria, Hinojosa, and Silva Memorandum Opinion by Justice Silva Appellant Luis Resendiz Romero a/k/a Luis Romero filed a notice of appeal from an order denying his application for writ of habeas corpus in trial court cause number DCF202100120 in the 18th District Court of Johnson County, Texas. 1 On July 28, 2022, we abated the appeal and remanded the case to the trial court because the certification of Romero’s right to appeal did not show that Romero had the right to appeal. See TEX. R. This case is before the Court on transfer from the Tenth Court of Appeals in Waco, Texas, pursuant to a docket equalization order issued by the Supreme Court of Texas. See TEX. GOV’T CODE ANN. § 73.001. 1 APP. P. 25.2(a)(2). However, on September 21, 2022, Romero filed a motion to dismiss the appeal. The motion was filed before we reached a decision in the case, and the motion was signed by both Romero and his attorney. See id. R. 42.2(a). Accordingly, we reinstate the appeal, grant Romero’s motion to dismiss, and dismiss the appeal. See id. Having dismissed the appeal at Romero’s request, no motion for rehearing will be entertained.
