NUMBER 13-20-00130-CV COURT OF APPEALS THIRTEENTH DISTRICT OF TEXAS CORPUS CHRISTI – EDINBURG CESAR ORNELAS LAW, PLLC AND CESAR ORNELAS II, Appellants, v. LORETTA CHAVEZ, Appellee. On appeal from the 94th District Court of Nueces County, Texas. MEMORANDUM OPINION Before Justices Hinojosa, Perkes, and Tijerina Memorandum Opinion by Justice Perkes Appellants Cesar Ornelas Law, PLLC and Cesar Ornelas II perfected their interlocutory appeal from an order denying their motion to dismiss under the Texas Citizens Participation Act. See TEX. CIV. PRAC. & REM. CODE ANN. §§ 27.003; 51.014(a)(12). On June 25, 2020, we abated this appeal and referred the case to mediation. Appellants have since filed an agreed motion to dismiss the appeal, informing the Court that the case has settled. The Court, having considered the documents on file and the agreed motion to dismiss, is of the opinion that the motion should be granted. See TEX. R. APP. P. 42.1(a)(1). Accordingly, the appeal is reinstated, the motion to dismiss is granted, and the appeal is hereby DISMISSED. In accordance with the agreement of the parties, costs are taxed against the party incurring same. See id. R. 42.1(d). Having dismissed the appeal at the appellants’ request, no motion for rehearing will be entertained, and our mandate will issue forthwith. GREGORY T. PERKES Justice Delivered and filed the 27th day of August, 2020. 2
