NUMBER 13-16-00697-CV COURT OF APPEALS THIRTEENTH DISTRICT OF TEXAS CORPUS CHRISTI - EDINBURG IN RE FARMERS TEXAS COUNTY MUTUAL INSURANCE COMPANY AND ERIKA VALLEJO On Petition for Writ of Mandamus. MEMORANDUM OPINION Before Justices Rodriguez, Garza, and Longoria Memorandum Opinion Per Curiam 1 Relators Farmers Texas County Mutual Insurance Company and Erika Vallejo filed a petition for writ of mandamus in the above cause seeking to compel the trial court (1) to vacate a November 30, 2016 order denying relators’ motion to sever and abate, and (2) to render an order granting that motion. The parties to this original proceeding have now filed an agreed motion to dismiss this cause on grounds that they have settled and compromised their differences. TEX. R. APP. P. 52.8(d) (“When denying relief, the court may hand down an opinion but is not required to do so.”); TEX. R. APP. P. 47.4 (distinguishing opinions and memorandum opinions). 1See The Court, having examined and fully considered the agreed motion to dismiss, is of the opinion that the motion should be granted. Accordingly, the Court GRANTS the agreed motion to dismiss and DISMISSES this cause as moot without reference to the merits thereof. Pending motions, if any, are likewise DISMISSED as moot. See TEX. R. APP. P. 52.8(a). IT IS SO ORDERED. PER CURIAM Delivered and filed this 28th day of December, 2016.
