TEXAS COURT OF APPEALS, THIRD DISTRICT, AT AUSTIN NO. 03-17-00576-CV Brandi K. Stokes, Appellant v. Christopher Lance Corsbie, Appellee FROM THE 200TH DISTRICT COURT OF TRAVIS COUNTY NOS. D-1-FM-16-005347 & D-1-FM-10-003078 HONORABLE ORLINDA NARANJO, JUDGE PRESIDING MEMORANDUM OPINION PER CURIAM Appellant Brandi K. Stokes has filed a motion challenging the trial court’s September 19, 2017 order sustaining the court reporter’s contest to Stoke’s affidavit of indigency. See Tex. R. App. P. 20.1(b); Tex. R. Civ. P. 145(g)(1) (review of trial court order on contest). Subsequent to the filing of her motion in this Court, Stokes filed a motion in the trial court, requesting that the trial court set aside its September 19 order. Following an evidentiary hearing, the trial court signed an order granting Stokes’s motion to set aside its September 19 order, sustaining in part the court reporter’s contest, and ordering Stokes to pay the reduced amount of $5,000 for the reporter’s record. See Tex. R. Civ. P. 145(f)(7) (allowing court to order partial and delayed payment of costs). On October 10, 2017, Stokes informed this Court that she has the funds to cover the reduced amount of $5,000, that her “[challenge to] the contest of indigency has become moot for all practical purposes,” and that she wishes to dismiss her challenge. We will treat Stokes’s request as a motion to dismiss, grant the motion, and dismiss Stokes’s challenge to the trial court’s order on the court reporter’s contest. Before Justices Puryear, Field, and Bourland Dismissed on Appellant’s Motion Filed: December 22, 2017 2
