TEXAS COURT OF APPEALS, THIRD DISTRICT, AT AUSTIN NO. 03-17-00369-CV Curtis Michael Green, Appellant v. Myra Laverne Green, Appellee FROM THE DISTRICT COURT OF TRAVIS COUNTY, 261ST JUDICIAL DISTRICT NO. D-1-FM-16-004159, HONORABLE AMY CLARK MEACHUM, JUDGE PRESIDING MEMORANDUM OPINION Appellant filed his notice of appeal in the trial court on May 30, 2017, complaining of the trial court’s final judgment signed April 13, 2017.1 On June 15, after the trial court clerk informed us that arrangements had not been made to pay for the clerk’s record, we sent appellant notice that the clerk’s record was overdue. We instructed appellant to pay for or make arrangement to pay for the clerk’s record and to file a response with this Court no later than June 26, warning that the appeal would be subject to dismissal if he did not comply with our request. To date, appellant has not responded to our request or otherwise communicated with this Court. We therefore dismiss the appeal for want of prosecution. See Tex. R. App. P. 42.3(b), (c). 1 It appears that the notice of appeal may have been untimely, but without a clerk’s record, we are unable to determine whether our jurisdiction was properly invoked. See Tex. R. App. P. 26.1. __________________________________________ David Puryear, Justice Before Justices Puryear, Pemberton, and Goodwin Dismissed for Want of Prosecution Filed: June 30, 2017 2
