TEXAS COURT OF APPEALS, THIRD DISTRICT, AT AUSTIN NO. 03-17-00354-CR Ex parte Stephanie Michelle Hurdsman, Appellant FROM THE DISTRICT COURT OF WILLIAMSON COUNTY, 26TH JUDICIAL DISTRICT NO. 15-0468-K26, THE HONORABLE DONNA GAYLE KING, JUDGE PRESIDING MEMORANDUM OPINION Appellant Stephanie Michelle Hurdsman seeks to appeal from an order denying her pretrial application for writ of habeas corpus. See Tex. Code Crim. Proc. arts. 11.05, 11.08. The trial court signed the order denying relief on April 26, 2016. Therefore, the deadline for perfecting appeal was May 26, 2016. See Tex. R. App. P. 26.2(a)(1). Appellant filed her notice of appeal on May 24, 2017. Thus, appellant’s notice of appeal—filed 393 days after the order was entered—is untimely. Absent a timely filed notice of appeal, we do not obtain jurisdiction to address the merits of the appeal in a criminal case and can take no action other than to dismiss the appeal for want of jurisdiction. See Slaton v. State, 981 S.W.2d 208, 210 (Tex. Crim. App. 1998); Olivo v. State, 918 S.W.2d 519, 522–23 (Tex. Crim. App. 1996). Accordingly, we dismiss this appeal for want of jurisdiction. __________________________________________ Melissa Goodwin, Justice Before Justices Puryear, Pemberton, and Goodwin Dismissed for Want of Jurisdiction Filed: June 16, 2017 Do Not Publish 2
