BRUCE BOYER, JUDGE PRESIDING MEMORANDUM OPINION Appellant Gacela Air Cargo S.A. de C.V. and appellee Berry Aviation, Inc., have filed a joint motion to dismiss this appeal with prejudice. In the motion, the parties represent that they have reached an agreement to resolve the claims and causes of action asserted in this case and that appellant no longer wishes to pursue its appeal. The parties ask that costs be assessed against the party incurring them.
