TEXAS COURT OF APPEALS, THIRD DISTRICT, AT AUSTIN NO. 03-16-00803-CV Barbara A. Hubbard, Appellant v. JP Morgan Chase Bank, N.A., Appellee FROM THE DISTRICT COURT OF TRAVIS COUNTY, 98TH JUDICIAL DISTRICT NO. D-1-GN-16-001896, HONORABLE ERIC SHEPPERD, JUDGE PRESIDING MEMORANDUM OPINION On January 25, 2017, this Court notified appellant Barbara A. Hubbard that the clerk’s record in the above cause was overdue and that we had received notice from the district clerk’s office that appellant had neither paid, nor made arrangements to pay, for the clerk’s record. This Court requested that appellant make arrangements for the record and submit a status report regarding this appeal on or before February 6, 2017. This Court further informed Hubbard that failure to do so may result in the dismissal of this appeal for want of prosecution. The deadline has passed, and this Court has received no response from Hubbard.1 Accordingly, we dismiss this appeal for want of prosecution.2 1 We have also received a motion to dismiss from appellee in which appellee represents that Hubbard is unopposed to dismissal. 2 See Tex. R. App. P. 42.3(b); see also Tex. R. App. P. 37.3(b). We dismiss appellee’s motion as moot. ____________________________________ Bob Pemberton, Justice Before Justices Puryear, Pemberton, and Goodwin Dismissed for Want of Prosecution Filed: April 19, 2017 2
