TEXAS COURT OF APPEALS, THIRD DISTRICT, AT AUSTIN NO. 03-07-00068-CV In re Reichhold, Inc. ORIGINAL PROCEEDING FROM TRAVIS COUNTY MEMORANDUM OPINION This Court abated this mandamus proceeding in 2007 after receiving notice that the underlying case had been removed to federal court. After the abatement, no party to this proceeding sought reinstatement. We have now been informed that the underlying case is closed and, therefore, have reinstated the mandamus proceeding. On June 19, 2017, the Clerk of this Court sent notice to the parties that this mandamus proceeding would be dismissed for want of prosecution unless a status report was filed on or before June 29, 2017, that provided reason to retain this proceeding. See Tex. R. App. P. 42.3(b). The Court received responses from two of the attorneys. One informed us that he believed the case should be dismissed. The other advised us that the underlying case in Travis County District Court had been dismissed with prejudice in 2008. No one has provided any reason why this proceeding should not be dismissed.
