Trial Court # D-164686

MEMORANDUM OPINION

Michael Pettus filed suit against George Meredith Bishop for legal malpractice alleging theories of negligence and violation of the Deceptive Trade Practices-Consumer Protection Act. The trial court rendered a post-answer default judgment in Pettus s favor. Bishop appealed. However, the trial court subsequently signed an order granting Bishop s motion for new trial.

This Court issued an order on August 28, 2002, advising the parties that this appeal would be dismissed for want of jurisdiction if a supplemental record containing a final judgment [wa]s not filed with the clerk of this court on or before 5:00 p.m. on September 11, 2002.

We have received no supplemental record containing a final judgment. Accordingly, we dismiss this appeal for want of jurisdiction. See Cook v. Lernout & Hauspie Med. Servs. Div., 76 S.W.3d 203, 203 (Tex. App. Waco 2002, no pet.).
