Appellees

From the 234th District Court

Harris County, Texas

Trial Court # 89-35337

MEMORANDUM OPINION

This is an appeal from a judgment signed on December 17, 1991. A timely motion for new trial and bond were filed, and the transcript was filed in the Houston 1st Court of Appeals on April 7, 1992.

Neither an appellant's brief nor a motion for extension of time for filing a brief have been received. On May 19, 1992, a request was made for the filing fee in this court which has gone unanswered.

The appeal is dismissed for want of prosecution and failure to tender the cost deposit.

Tex. R. App. P. 74(l)(1) and 13(a)(i).

Justice Cummings, and
