In The Court of Appeals Sixth Appellate District of Texas at Texarkana No. 06-21-00084-CV CHRISTOPHER MITCHELL, Appellant V. LAKEISHA RANDLE, Appellee On Appeal from the County Civil Court at Law No. 4 Harris County, Texas Trial Court No. 1170898 Before Morriss, C.J., Burgess and Stevens, JJ. Memorandum Opinion by Justice Burgess MEMORANDUM OPINION Christopher Mitchell filed a timely notice of appeal on September 7, 2021.1 The clerk’s record was filed on September 8, 2021. No reporter’s record was taken in this case. The original deadline for Mitchell’s appellate brief was October 13, 2021. On Mitchell’s request, this Court extended the deadline for filing his brief to November 15, 2021. On November 15, 2021, Mitchell attempted to e-file his brief through eFileTexas.gov. That one-page document was rejected by our clerk’s office, however, because it was illegible. On December 1, 2021, this Court advised Mitchell by letter that the brief was late. We also extended the deadline for filing the brief to December 16, 2021. We warned Mitchell that the failure to file a brief by the December 16, 2021, deadline would subject this appeal to dismissal for want of prosecution. See TEX. R. APP. P. 38.8(a)(1), 42.3(b), (c). Mitchell has not filed his brief in compliance with this Court’s deadline. Having received no brief and no motion for extension of time in which to file a brief from appellant, Mitchell’s appeal is ripe for dismissal for want of prosecution. Consequently, pursuant to Rules 38.8 and 42.3 of the Texas Rules of Appellate Procedure, we dismiss this appeal for want of prosecution. See TEX. R. APP. P. 38.8(a)(1), 42.3(b), (c). Ralph K. Burgess Justice Date Submitted: Date Decided: January 6, 2022 January 7, 2022 1 Originally appealed to the Fourteenth Court of Appeals, this case was transferred to this Court by the Texas Supreme Court pursuant to its docket equalization efforts. See TEX. GOV’T CODE ANN. § 73.001. 2
