Memorandum Opinion by Justice Carter MEMORANDUM OPINION Valentin Ugarte Camilo appeals his conviction for felony driving while intoxicated. See TEX. PENAL CODE ANN . ยงยง 49.04, 49.09 (Vernon 2003 & Supp. 2008). Camilo raises two issues related to this appeal, both of which challenge the trial court's ruling on his motion for new trial. These issues were also raised in Camilo v. State, cause number 06-08-00164-CR. Since the arguments presented are identical in each appeal, for the reasons stated in Camilo v.
